HANSON CONSERVATION COMMISSION
MINUTES OF THE PUBLIC MEETING OF JUNE 13TH, 2006
TOWN HALL, 542 LIBERTY STREET, HANSON, MA


Called to Order at 7:30 PM under M.G.L. Chapter 131, s.40 and the Hanson By-Law 3-13, s.5. by Philip R. Lindquist, Chairman, in Meeting Room A on the top floor at the Town Hall.

Approval of Minutes:   

 The acceptance of the minutes of May 23rd, 2006 were postponed until June 27, 2006.
Appointments

7:30 PM  Jeffry Landreville,  632 State StreetEO/requires ratification

In response to a Building Permit application for a swimming pool and basketball court, Ms. Delaney had made a site visit and discovered filling of wetlands at the above-mentioned property. Subsequently, an Enforcement Order had been issued to Mr. Landreville outlining conditions that included establishment of the wetland line under the supervision of a wetland scientist by pulling the fill out of the wetland and a restoration plan.  A Notice of Intent was required for the restoration and additional activities such as swimming pool and basketball court could be included on the Notice so that his construction can be accomplished simultaneously.  Mr. Landreville was at the meeting and submitted pictures of the extent of the clearing and filling in his backyard.

Vote:  4-0-0  *Mr. Schellenger left the meeting at 7:40 PM temporarily and did not vote.


Public Hearings

7:45 PM  Request for Determination of Applicability for the installation of a septic system at 172 Monponsett St., Map 31, Lot 28-1 for Jean Allen represented by Alan Dias General Contracting, P.O. Box 314, Monponsett, MA  02350 –continued per request of Alan Dias to June 27th, 2006 at  8:45 PM

8:00 PM  Three (3) Requests for Determination of Applicability to determine if the excavation of test pits in order to conduct percolation tests in accordance with Title 5 are subject to the jurisdiction of the Mass. Wetlands Protection Act or the Hanson Wetlands By-law at 1443 Main St., Map 44-1, Lots 3, 4 & 5 for Chilmark Company, 345 Washington St., Pembroke, MA  02359

This hearing was tabled momentarily because the applicants couldn’t be located in the hallway.  However, later in the meeting, David Harris read the Public Hearing Notice and the abutters were verified.  No abutters were present.  Ms. Delaney commented that the wetland line on Lot 4 is not accurate, however, it is offsite and has no bearing on this application.    She recommended approval with the condition that the line is corrected upon the filing of a Notice of Intent or Request for Determination of Applicability to develop the lot.

8:15 PM  Continued  Request to Accept a Revised Plan at 255 Rear Liberty Street, Assessors Map 82, Lot 6-1 for Dennis Leary, Trustee for Hudson Park Associates, N.T., 2 Columbia Rd., Pembroke, MA  02359   (DEP #175-0433) – continued per request of applicant to June 27, 2006 at 7:45 PM

Dave Harris questioned whether to continue a decision again.  Ms. Delaney commented that the project had already been approved by the Commission.  Because  stormwater management has been addressed, the proposed revisions are an improvement .  The applicant requested a continuance because the Review Engineer, John Delano, is still awaiting drainage calculations.

8:30 PM Continued Notice of Intent for construction of a single family home, driveway and utilities as well as a proposed wetland crossing at 30 Holmes Street, Map 75, Lot 5-1 for Anthony Kolacz represented by Kenneth Thompson, 134 Spring St., Rockland MA  (DEP #175-0495) – continued until June 27th, 2006 at 8:30 PM due to new information submitted too late for review

8:45 PM Continued Notice of Intent for a revised proposal for the construction of eight (8) single-bedroom condominium units with parking and septic within 100 feet of a bordering vegetated wetland at 1139 Main St., Assessor’s Map 43, Lots 36A & B and 36.  A portion of the construction falls within the 100-foot inner riparian zone. Proposal includes clean up of existing construction debris and soils on Lot 36.   Applicant:   Demco Enterprises, Inc., 31 Perkins Street, Bridgewater, MA  02324 represented by Land Planning, Inc.. (DEP #175-0460)



Bob Crowell of Land Planning  presented a revised plan that delineated a Conservation Restriction around the perimeter of the parking lot.  He stated that the septic system won’t be Board of Health approved until the adjacent parcel of land has been purchased.  John Delano, the Review Engineer for the Commission, has requested additional tests pits in the area of the proposed detention basin. Ms. Delaney requested that an application for a Previously Developed Riverfront Area is submitted.  Mr. Crowell would like to set up a site visit with the Commissioners.  Phil Lindquist advised Mr. Crowell that the Commission, per the advise of Mr. Delano, will require the additional test pits.

9:00 PM Continued Abbreviated Notice of Resource Area Delineation for the confirmation of a wetland line at 1101 Rear Main Street, Map 42, Lots 60 & 60A for Frank Bridgeman represented by Land Planning, Inc., 1115 Main Street, Hanson, MA  (DEP #175-498)

Land Planning had submitted a revised plan that illustrated the Commission’s Consultant, Walter Hewitson’s wetland flags that were in contrast to those of the Applicant’s consultant Sharon LePorte.  In addition, both Consultants had submitted narratives explaining differing points of view in relation to whether a specific area is to be considered a wetland. Ms. LePorte attended the hearing along with Bernie Munro from Land Planning, the applicant, Frank Bridgeman and his attorney, Robert Landry.  Ms. Delaney recommended that the Commission follow the advice of Dr. Walter Hewitson and deem the inundated area a wetland.  Mr. Bridgeman, at this point, verbally withdrew his application.  Mr. Lindquist announced that the matter was off the table.

Enforcement Issues

Stonebridge Commons (SE 175-396) – Ms. Delaney reported that during a site visit, she had noticed siltation over the erosion control into an adjacent wetland.  The Commission was not notified of this breach.  Ms. Delaney had threatened a Cease and Desist Order unless measures were taken to prevent further siltation.  On Friday, June 9th, Emerald Excavating had installed filter socks to catch the sediments.  Ms. Delaney felt they were making a good effort, but a restoration plan was needed for the silted wetlands.  John Barrows, P.E., representing Marchionda and Associates attended the meeting to explain that every effort was being made to prevent it from happening again.  


Jon Ridder, Main Street – A meeting in Boston with all parties was cancelled and re-scheduled because Mr. Ridder had not provided the DEP with the revised Farm Plan.
Jon Ridder, Ransom Road – Ms. Delaney spoke with Attorney Sean Walsh from DEP.  Mr Walsh concluded after discussion with Gary Makuch, Tena Davies and Elizabeth Koleheras, also of DEP , that Mr. Ridder should have filed for a Limited Project for his new road.  It was not considered an exempt activity within a Farm Plan.
141 Pennsylvania Ave – The Commission made a decision to meet onsite with the owner’s permission this Saturday.
62 Ocean Ave. (DEP#SE175-0454)  Ms. Delaney reported no progress related to Enforcement Order and added that some of the debris deposited in the wetland at Dean Anderson’s is on an adjacent property belonging to Barbara Spencer.  Ms. Delaney felt that Ms. Spencer was somewhat responsible as she was, in effect, allowing the violation.  Ms. Delaney will draft a letter.  
Lakeside Drive (DEP#SE175-395) – Ms. Delaney reported that in response to an Enforcement Order, Coleman Earner had replaced some of the haybales, but some had been moved further into the wetland and others were covered with dirt and were not working as designed to prevent siltation.  She had drafted a new Enforcement Order to comply with the first one under the supervision of the Town Engineer, John Delano and a deadline of July 14, 2006.

Invoice Documentation and Authorization Memo from Town Accountant – Needs clarification

E-mail message from owner of Lot 4, William Way re:  access easement Ms. Delaney will get samples of Conservation signs from other Towns and establish exactly where the easement is.

NHESP – Redbellied Turtle identification – Ms. Delaney reported a call from Natural Heritage on 6/12/06.  Jenna Garvey, NHESP, reported that photos sent to NHESP were analyzed by two additional experts who did not conclude the turtles to be Painted Turtle and questioned the possibly that the hatchling was in fact a Redbellied Turtle.  NHESP requested additional pictures and a video of the turtle to analyze.

Ms. Delaney reported that she had spoken with Victor Deniak, DPW Superintendent for Hanover, about the status of the Factory Pond Dam.  Apparently, they are footing the cost of analysis, but if there are any necessary repairs, the cost would have to be shared by both Town’s.

Rod & Gun Club – Ms. Delaney had made a site visit with Bernie Munro of Land Planning to review upgrade plans for the Rod & Gun Club.  The club is also contemplating a new firing range.  The agent informed Mr. Munro that a portion of the area targeted for expansion is a wetland.  

795 Main Street –  Ms. Delaney will draft a letter to the Tamulevich’s asking for a solution to their neighbor’s flooding problems because of the installation of their septic.
